Maguindanao massacre: final judgement

MANILA, Philippines – After a decade of waiting, the verdict on the Maguindanao massacre has finally been promulgated today, December 19 at Camp Bagong Diwa in Taguig City.

Quezon City Regional Trial Court Branch 221 Judge Jocelyn Solis-Reyes read her decision and concluded that the following are considered "Guilty beyond reasonable doubt":

Ampatuan Family

They will face reclusion perpetua or 40 years in prison for each count, although the Revised Penal Code limits service of prison sentence to a maximum of 40 years.

Among those who were acquitted was Datu Akmad “Tato” Ampatuan, Sr., and Datu Sajid Islam Ampatuan. Sajid, a brother of the principal accused was already out on bail after witnesses said he didn't say a single word during the meeting. He was absent during the promulgation.

Judge Reyes' decision was written in more than 700-pages but was agreed by all parties that only the salient points will be read. Only the dispositive portion of the decision was read.

Under the law, the prosecution had the burden to prove that the killings had any of the following elements: evident premeditation, taking advantage of superior strength, treachery, cruelty, in an uninhabited place, by a band, or armed with firearms.

On the day of the promulgation of judgement, all 101 out of a total 197 accused charged with murder appeared in court with their respective lawyers.
